Thumbs Up Photography - The Exhibition
Terms and Conditions
1. General
1.1. These terms and conditions ("Terms") govern your participation in the "Thumbs Up Photography - The Exhibition" (the "Exhibition") organized by Thumbs Up Photography ("Organizer").
1.2. By submitting your photographs and/or participating in the Exhibition, you agree to be bound by these Terms.
1.3. The Organizer reserves the right to amend these Terms at any time. Any changes will be updated here.
1.4. In the event of any dispute regarding the Terms or the Exhibition, the Organizer's decision shall be final and binding.
2. Eligibility and Submission
2.1. The Exhibition is open to all photographers who are members of the Thumbs Up Facebook community who wish to submit their work.
2.2. Submissions must be made via the Google Form provided by the Organizer.
2.3. All submitted photographs must be the original work of the entrant.
2.4. By submitting photographs, the entrant warrants that they own the copyright to the images and have obtained any necessary permissions from individuals depicted in the photographs.
2.6. The Organizer reserves the right to disqualify any submission that does not comply with these Terms or is deemed inappropriate.
3. Selection
3.1. The Organizer will select the photographs to be displayed in the Exhibition.
3.2. The selection criteria will be at the discretion of the Organizer.
4. Exhibition Details
4.1. The Exhibition will be held in the foyer of Three/Snowhill, Birmingham but is subject to change.
4.2. The Exhibition will run from Thursday, June 12th, for approximately 4 months (subject to change)
5. Printing and Framing
5.1. If an image is selected, the entrant will be required to choose the size of their print for display, based on the costs provided by the Organizer.
5.2. The costs provided by the Organizer are inclusive of print (Permajet archival paper) with border, mount, framed in a black frame, float glass, MDF backing, fully assembled, and delivered to Three/Snowhill.
5.3. The entrant is responsible for paying the initial exhibition cost for their chosen print size.
5.4. The Organizer will arrange for the printing, framing and delivery of selected images to the exhibition.
6. Payment
6.1. Once images have been selected, the Organizer will email entrants details on how to complete payment for the initial exhibition cost.
7. Sales of Prints
7.1. The Organizer will handle the online sales, payment processing, printing, packaging (in a presentation box), and delivery of purchased prints to customers.
7.2. The selling price, printing cost, admin fee, charity donation, postage cost, and profit share for the photographer will be as outlined by the Organizer.
7.3. The Organizer will distribute the photographer's profit share after deducting the relevant costs.
7.4. The Organizer is responsible for determining the final selling price of prints.
8. Copyright and Usage
8.1. The entrant retains copyright of their submitted photographs.
8.2. By submitting photographs, the entrant grants the Organizer a non-exclusive license to: * Display the photographs in the Exhibition. * Reproduce the photographs in the Exhibition catalog. * Use the photographs for promotional purposes related to the Exhibition (e.g., on social media, website, press releases). * Reproduce the photographs online for the purposes of facilitating sales of prints.
8.3. The Organizer will credit the photographer where possible when using their images.
9. Liability and Insurance
9.1. The Organizer will take reasonable care in handling the submitted and exhibited photographs. However, the Organizer is not responsible for any loss or damage to the photographs during submission, transit, exhibition, or return (if applicable).
9.2. Entrants are responsible for ensuring they have appropriate insurance coverage if they deem it necessary.
10. Return of Prints
10.1. Entrants have the option to reclaim their initial framed print at the end of the exhibition.
10.2. The responsibility for collecting and arranging the return of their framed print at the conclusion of the exhibition lies solely with the entrant.
10.3. The Organizer will provide reasonable notice of the exhibition's end date and instructions for collection.
10.4. Any prints not collected by the entrant within 14 days of the exhibition's end date may be disposed of by the Organizer at their discretion. The Organizer will not be held responsible for any prints left uncollected after the given time frame.
11. Data Protection
11.1. The Organizer will collect and process personal data (such as names and contact information) for the purpose of administering the Exhibition, facilitating sales, and communicating with entrants.
11.2. The Organizer will handle personal data in accordance with applicable data protection laws.
12. Charity Donation
12.1. A portion of the proceeds from print sales will be donated to the chosen charities.
13. Force Majeure
13.1. The Organizer shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited 1 to: * Acts of God (e.g., natural disasters, pandemics, severe weather conditions). * War, terrorism, civil unrest, or riots. * Strikes, labor disputes, or industrial actions. * Government regulations, restrictions, or orders. * Fire, flood, or other accidents. * Failure of third-party services or suppliers beyond the Organizer's control. * Venue closure, or venue becoming unusable.
13.2. In the event of a Force Majeure, the Organizer will make reasonable efforts to notify participants of the situation and any resulting changes or cancellations.
13.3. If the Exhibition is cancelled or postponed due to a Force Majeure event, the Organizer will not be liable for any costs, expenses, or losses incurred by participants. The organiser will make reasonable efforts to refund any payments made by participants, minus any irrecoverable costs already incurred.
13.4. The Organizer reserves the right to make decisions regarding the continuation, postponement, or cancellation of the Exhibition in the event of a Force Majeure, and such decisions shall be final.
